Please read these Terms and Conditions carefully before using FaidaRise’s risk-free betting service.

Interpretation and Definitions

Interpretation

Words with capitalized initial letters have specific meanings defined below. These definitions apply whether the terms are singular or plural.

Definitions

For the purposes of these Terms and Conditions:

  • Affiliate means an entity that controls, is controlled by, or is under common control with a party, where “control” means ownership of 50% or more of the shares, equity interest, or other securities entitled to vote for election of directors or other managing authority.
  • Country refers to: Kenya.
  • Company (referred to as “the Company”, “We”, “Us”, or “Our”) refers to FaidaRise Interactive Technologies Limited, a company registered in Nairobi, Kenya.
  • Device means any device that can access the Service, such as a smartphone, computer, or tablet.
  • Service refers to the FaidaRise website, app, risk-free betting tools (including Dutching and, in future versions, matched betting), and community forums.
  • Terms and Conditions (also referred to as “Terms”) mean these Terms and Conditions that form the entire agreement between You and the Company regarding the use of the Service.
  • Third-party Social Media Service means any services or content (including data, information, products, or services) provided by a third party that may be displayed, included, or made available by the Service, such as WhatsApp or Instagram.
  • Website refers to FaidaRise, accessible from https://faidarise.com.
  • You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

Acknowledgment

These Terms and Conditions govern your use of FaidaRise and the agreement between you and the Company. They outline your rights and obligations as a user of our betting tools and community forums.

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms and Conditions. These Terms apply to all visitors, users, and others who access or use the Service.

By accessing or using the Service, you agree to be bound by these Terms and Conditions. If you disagree with any part of these Terms, you may not access the Service.

You represent that you are over the age of 18, as betting in Kenya is restricted to adults under the Betting, Lotteries and Gaming Act, 1966. FaidaRise does not permit those under 18 to use the Service.

Your use of the Service is also conditioned on your acceptance of and compliance with our Privacy Policy. Our Privacy Policy explains how we collect, use, and protect your personal information, as well as your privacy rights under Kenyan law. Please read it carefully before using FaidaRise.

Nature of Service

FaidaRise is a Business to Customer(B2C) data analytics platform that provides tools and insights for betting strategies, such as Dutching and, in future versions, matched betting. We do not accept wagers, operate as a bookmaker, or facilitate gambling activities. Instead, we analyze betting data and odds to help you make informed decisions when placing bets with third-party bookmakers (e.g., SportPesa, Betika). You are solely responsible for any bets placed with these third parties, and FaidaRise is not liable for any losses, disputes, or outcomes resulting from your betting activities

Subscription and Payment

Subscription

FaidaRise offers a subscription-based Service at KES 1,500 per month, with a 2-week free trial for new users. By subscribing, you agree to pay the subscription fee on a recurring monthly basis until you cancel your subscription.

Payment

Payments are processed through secure third-party payment providers (e.g., M-Pesa). You agree to provide accurate payment information and authorize us to charge the subscription fee to your chosen payment method.

Cancellation and Refunds

You may cancel your subscription at any time through your Account settings. Upon cancellation, your access to paid features will continue until the end of the current billing cycle. We do not offer refunds for partial months or unused trial periods, except as required by Kenyan law under the Consumer Protection Act, 2012.

User Responsibilities

Account Usage

You are responsible for maintaining the confidentiality of your Account credentials and for all activities under your Account. Notify us immediately at [email protected] if you suspect unauthorized use of your Account.

Prohibited Activities

You agree not to:

  • Use the Service for illegal betting activities under Kenyan law.
  • Share your Account with others or allow unauthorized access.
  • Attempt to reverse-engineer, hack, or interfere with FaidaRise’s betting tools.
  • Post harmful, offensive, or illegal content in our community forums.
  • Use the Service to promote bookmakers or competing betting services.

Violation of these terms may result in immediate termination of your Account.

FaidaRise may link to third-party websites or services, such as SportPesa or Betika, which are not owned or controlled by us.

We have no control over and assume no responsibility for the content, privacy policies, or practices of these third-party sites. You acknowledge that FaidaRise is not liable for any damage or loss caused by your use of or reliance on such sites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party sites you visit.

Termination

We may terminate or suspend your access to FaidaRise immediately, without prior notice or liability, if you breach these Terms and Conditions, engage in illegal betting activities, or for any other reason at our discretion.

Upon termination, your right to use the Service will cease immediately, and any active subscription will be canceled without refund, except as required by law.

Limitation of Liability

To the maximum extent permitted by Kenyan law, FaidaRise and its suppliers shall not be liable for any special, incidental, indirect, or consequential damages (including loss of profits, data, or betting opportunities) arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim under these Terms shall be limited to the amount you paid through the Service in the past 3 months, or KES 1,500 if you have not paid for the Service.

”AS IS” and “AS AVAILABLE” Disclaimer

FaidaRise is provided “AS IS” and “AS AVAILABLE” with all faults and defects, without warranty of any kind. To the maximum extent permitted under Kenyan law, we disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that:

  • The Service will meet your betting expectations or guarantee profits.
  • The Service will be uninterrupted, error-free, or compatible with all devices.
  • Betting insights or odds provided will be accurate or up-to-date.
  • The Service, its servers, or communications are free of viruses or harmful components.

Under the Consumer Protection Act, 2012, you may have rights that cannot be excluded. In such cases, exclusions will apply to the greatest extent permitted by law.

Governing Law

The laws of Kenya, excluding its conflicts of law rules, shall govern these Terms and your use of FaidaRise. Your use of the Service may also be subject to other local or international laws, including the Betting, Lotteries and Gaming Act, 1966.

Disputes Resolution

If you have any concerns or disputes about FaidaRise, you agree to first attempt to resolve the issue informally by contacting us at [email protected]. If the dispute remains unresolved, it shall be settled in accordance with Kenyan law, and you may escalate the matter to the relevant authorities, such as the Betting Control and Licensing Board.

For European Union (EU) Users

If you are an EU consumer accessing FaidaRise, you may benefit from mandatory provisions of the law of your country of residence. However, as FaidaRise primarily operates in Kenya, Kenyan law will generally apply.

You represent and warrant that:

  • You are not prohibited from engaging in betting activities under Kenyan law.
  • You will comply with all applicable laws, including the Betting, Lotteries and Gaming Act, 1966, when using FaidaRise.
  • You are not using the Service for money laundering or other illegal activities.

Severability and Waiver

Severability

If any provision of these Terms is held to be unenforceable or invalid under Kenyan law, such provision will be modified to achieve its intended purpose to the greatest extent possible, and the remaining provisions will remain in effect.

Waiver

Failure to enforce any right or provision under these Terms does not waive our ability to enforce it later. A waiver of any breach does not constitute a waiver of subsequent breaches.

Translation Interpretation

These Terms and Conditions may be translated for your convenience. In case of a dispute, the original English version shall prevail.

Changes to These Terms and Conditions

We may update these Terms at our discretion. For material changes, we will provide at least 14 days’ notice via email or a notice on FaidaRise, prior to the changes taking effect. Material changes include updates to subscription fees, user responsibilities, or liability terms.

By continuing to use FaidaRise after the changes take effect, you agree to the revised Terms. If you do not agree, please stop using the Service.
